Acceptance of Terms

By downloading, installing, or using the Tirthankara app ("the app"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the app.

Use of the App

The app is provided for personal, non-commercial, educational use. You may browse, read, and share content within the app for personal learning and spiritual practice.

User Accounts

Creating an account is optional. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and be at least 13 years of age. We reserve the right to suspend or terminate accounts that violate these terms.

Content

All content in the app is provided for informational and educational purposes only. While we strive for accuracy, we make no warranties regarding the completeness or accuracy of the information. Content is based on publicly available encyclopedic sources and sacred texts in the public domain, and is presented in a non-sectarian manner.

Kalash Offerings

The app allows voluntary Kalash offerings processed through Razorpay. All offerings are voluntary and non-refundable unless required by applicable law. By making an offering, you also agree to Razorpay's Terms of Service.

Intellectual Property

The app design, layout, icons, and original descriptions are the intellectual property of the app creator. Sacred texts and prayers are part of the public domain Jain literary tradition. Images are sourced from Wikimedia Commons under their respective open licenses. You may not reproduce, distribute, or create derivative works from the app's proprietary elements without written permission.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. For matters of religious practice, please consult qualified Jain scholars or your spiritual community.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE APP CREATOR, ITS AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ₹500, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless the app creator from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the app or violation of these terms.

Termination

We may suspend or terminate your access to the app at any time, with or without cause, and without prior notice. Upon termination, your right to use the app ceases immediately. Sections on Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law survive termination.

Apple End User License Agreement

If you access the app through the Apple App Store, you acknowledge that these Terms of Use are between you and the app creator, not Apple. The app is licensed to you under the Apple Licensed Application End User License Agreement (LAEULA). Apple has no obligation to provide maintenance, support, or warranty for the app. In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); beyond that, Apple has no other warranty obligation. Apple is not responsible for any third-party claims relating to the app.

Third-Party Services

The app uses third-party services including Firebase (Google) and Razorpay. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra, India.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Changes to Terms

We reserve the right to update these terms at any time. We will update the effective date above when changes are made. Continued use of the app after changes constitutes acceptance of the updated terms.
